Theory, practice and prospects of foster care in the Czech Republic Abstract The thesis deals with the issue of foster care, as a traditional private law institute of alternative family care, which has significant public law features. The aim of the thesis is to provide a comprehensive view of the legal regulation of foster care de lege lata not only from a theoretical perspective, but also to point out some practical consequences of the application of the legal regulation in question. Part of the thesis is also devoted to the prospects of regulatory developments of foster care following the upcoming legislative changes in the field of alternative care for children. If, from objective or subjective reasons, the child's parents cannot personally care for the child, the state must ensure a suitable alternative care for such a child. One of these forms of alternative care is foster care, which provides a solution to the lack of personal care for child by his or her parents in an environment that resembles a family as much as possible. Master's Degree Thesis. The object of this work is to identify the weaknesses of the current system of the alternative care by comparing casuistry with the standards of quality. I use casuistry of the current or former clients of foster care. In the first part I put the topic of social and legal protection of children into context of international and constitutional documents. There is also a chapter about the Standars Quality4Children. Then I focus on the situation in the Czech republic. I start with the descripction of the current system and finish with the process of transformation of the system of care for children at risk. The bill changing the Act No. 359/1999 Coll. on the social and legal protection of children was published. It is the first step to the transformartion and it's necessary to be followed-up other steps. The actual explorative empirical part of this work is conducted by a qualitative research strategy. This thesis deals with the System of care for vulnerable children in the Czech Republic and the increasing number of children in institutional care. While processing was used mainly qualitative methods of collecting data through its own survey in the offices of municipalities with extended competence of employees engaged in the exercise of social and legal protection of children and interviews with selected staff of facilities for institutional care. There was also carried out a secondary analysis of data. Finally, there are some partial measures, whose implementation could improve the situation of vulnerable children in society and reduce the number of children placed in institutional care.
Host care in the Czech Republic

The diploma thesis is focused on host care in the Czech Republic. The first chapter deals with attachment and its explanation. The second chapter describes alternative care in the Czech Republic. The list of alternative care forms and types of institutional care are included in this part. The third chapter is focused on host care and its legislative framework, forms, advantages, risks and the process of host care mediation. In the fourth chapter there are introduced specific examples of host care. The fifth chapter describes the survey methodology focused on host care. The sixth chapter contains thequestionnaire survey assessment. To define the issue, the author uses specialized literature aimed at substitutional family care and host care, Czech laws (i.e. Social-legal protection of the children law, Civil code, the law of institutional care accomplishment). She also derives from websites occupied by host care, such as civic association Děti patří domů, The Centre for Adoption and Foster Care. The aim is to verify theoretical facts followed from specialized sources and the description of host care in the Czech Republic.

Summary: This work proposes a closer look at the divorce-related topics with consequential impacts both on financial situation of divorced spouses and destinies of minor children as resulting from divorced marriages in Czech Republic. Till date, this issue has been solved in different ways at both district and regional courts. In our republic, a more unifying element is represented by decisions of the Supreme and Constitutional Courts. This is a very serious social phenomenon which, according to statistics affects a large number of parents, children, but also childless partners. Yet from ancient times this phenomenon is known to be socially undesirable being almost entirely rejected by the Catholic Church in its canon law. The increase in divorces has resulted namely from the advancement procedure of society. It is a societal phenomenon known to occur irrelatively of the states and political systems, from the totalitarian regimes through those autocratic, up to highly democratic systems of developed countries worldwide. The various forms of alternative institutional child care in the Czech Republic

The bachelor thesis focusses on psychological issue of institutional care in the first part. The beginning devotes to historical development of alternative care of children up to present. The thesis focusses on issue of taking a child from the primary family and placing him or her to the institutional care. It devotes the topic of risk parents and children. A big part of the thesis relates to mental deprivation, its definition, reactions' typology, diagnostic and psychotherapy. In the next part, there are described the psychological development's specialities of mentally deprived children, then a child's return to the primary family, a child's transition to alternative care, and the issue of individuals leasing the institutional care after reaching their legal age. Last part deals with specific topics connected with alternative care concerning children with ethnic differences or with special needs. A quantitative study detecting the influence of long-term stay in the institutional care on economical behaviour and attitudes is designed in the second part. It is designed for adolescents, who grow up in institutional care and foster care for a long time. Adolescents growing up in biological families are the control group. Transformation and Deinstitutionalization in Substitutional Child Care System in the Czech Republic

Substitutional child care is an indispensable part of system of social and legal protection of children. Until 1989, institutional care was preferred, while after the fall of communist government it had been gradually replaced by substitutional family care, because of the inappropriateness of institutional care to fully compensate for family environment. Deinstitutionalization means transforming the system of placing children to alternative care and it is understood as transition from institutional care to types of substitutional family care, eventually to more individual type of care with more family character. An amendment to the Social and Legal Children Protection Act, which aimed at transforming the system of substitutional care towards more individual work with endangered children, came into force in 2013. The amendment restored the institute of temporary foster care and modified the institute of long-term foster care. This Bachelor thesis addresses the issue of the basic human rights of Refugee Children guaranteed to every child by UN Convention on the Rights of the Child adopted in 1989. The thesis describes the processes and situations in which a Refugee Child who is accompanied by family members or who is an Unaccompanied Minor goes through during the proceeding of International Protection in the European countries. The thesis focuses only on the articles of Convention that are applicable to crucial problems in the current situation of Refugee Children.
